Truehope "raids" Health Canada

Truehope "Raids" Health Canada...

Opinion by Consumer Advocate Tim Bolen

Tuesday, November 3rd, 2009

Yesterday, a Canadian company Truehope, the makers of EMPowerplus, the first supplement product in North America to be protected against attack by a government agency by the Court System, started their second round of assault against Health Canada.

Let's wish them well...

In their first round they slapped Health Canada around a Canadian Courtroom, getting the Court to Order Health Canada to leave them alone.  The Court ruled, simply, that EMPowerplus, a supplement product that reverses Bi-Polar issues, did not require approval from Health Canada, and that it was "a necessity" to the people that used it.  Health Canada employees had stopped entry of the product into Canada (it is manufactured in the US) causing several people to die, and many others to suffer, without it.  No Health Canada employees, however, were ever criminally indicted for those deaths.

Yup - they are attacking Health Canada one more time - and if they win this assault they will have completely removed Health Canada's teeth, so to speak.  Health Canada might as well, after this, lock the doors and send the employees home.

Why?  Because if Truehope has their way Health Canada won't be able to attack Vitamin Supplement companies any more.  It has been a simple fact that Health Canada, from the top down, sees its role as protecting the pharmaceutical industry it is supposed to be regulating against competition.

Health Canada claims in its Mission Statement to so certain things, in reality it does exactly the opposite.  Read this below, from their website:

"Health Canada is the Federal department responsible for helping Canadians maintain and improve their health, while respecting individual choices and circumstances.  According to our mission and vision, Health Canada's goal is for Canada to be among the countries with the healthiest people in the world."

The old adage "Actions speak louder than words" comes into play here when you take a hard look at Health Canada.  When you do that there are only two choices here to consider:  (1)  either that is NOT Health Canada's true Mission Statement, and the agency website is a fraud, or (2)  certain employees (a lot of them, from the top down) are intentionally ignoring what the people of Canada set them in place, and ordered them to do, on their behalf.

I go for choice number two.  In this Health Canada duplicates the everyday duplicity in US agencies, like the US FDA and the CDC.

Removing Health Canada's Teeth...

In a letter I received from Truehope:

"Truehope co-founder Anthony Stephan claims that if the constitutional challenge is successful Health Canada will no longer be able to remove a product from the market without first proving in court that the removal will not harm Canadians who use it for their health. “Canadians are harmed when viable natural treatments or preventions are taken away. Drugs should not be the only option for Canadians who choose health. The judgment will extend protection to all Canadians and to all natural health products.”

Current Health Canada regulations allow bureaucrats to remove natural products at will without any accountability to Canadians for their actions.2 “We think this kind of unconstitutional freefor-all opens the door for corruption and for big pharma lobby, and closes the door on individual freedom and choice in personal health care,” says Stephan."

In short, it is a Constitutional Challenge to two subparagraphs of the Food and Drug Act - section 23(1)(d) and section 26.  The action claims that those two sections violate Sections 7 and 8 of  the Canadian Charter of Rights and Freedoms.  These two subparagraphs are the "teeth" of Health Canada.  Just below is the explanation, from the Court Documents, of the two sections:

The Constitutional Challenge, however, maintains that allowing this unrestrained activity by Health Canada violates sections 7 and 8 of the Canadian Charter of Rights  - for several reasons - and wants these sections struck down.  Below is why they want section 23 (1)(d) struck down:

Then they attack section 26 in much the same way...

Then they attack both sections...

But then it gets even better...

We'll keep you posted.

Stay tuned...

Senator McCoy’s insider view on the Senate Hearings continues

Subject: Senator McCoy’s insider view on the Senate Hearings continues…

By Dee Nicholson,

Our much-loved Senator McCoy again gives us precious insight as to what is happening in the Standing Committee Hearings on Bill C-6, and includes a note that Shawn Buckley will testify, after all, on November 25th.  This is good news indeed, as it means that the Senate will hear legal analysis which bears on the correct issues, instead of the blather of Health Canada’s power-grabbers.

However, we are still awaiting a response from the Clerk of the Senate, Ms. Keli Hogan, with respect to whether our delegates for Canadians for Health Freedom, Freedom in Canadian Health Care, and the Vaccine Resistance Movement will be heard, and when.

One of the issues apparently causing some consternation to the Senators is the potential for mandatory vaccinations facilitated by the Bill, as they regard this as a ” conspiracy theory”.  We have avoided mention of this issue for the simple reason that the Bill is offensive enough, and has enough potential for harm, without even thinking about mandatory vaccinations.  Our sole concern is “due process of law”, without which no Canadian’s rights are sacrosanct, if the government so decides, and there exists no legal mechanism to defend oneself from the intrusion of the State.

That is no conspiracy theory.  It is a real potential, which is what has been of concern to Senators like Elaine McCoy, who was quick to point out that the Bill apparently was using a cannon to kill a fly.  The only thing “theoretical” here is the REASON for all this:  either there is a hidden agenda behind the language of C-6, OR our government is completely incompetent.  Neither is an appealing concept, but ONE of them must be true… so which would YOU prefer?  For myself, I’d rather find the culprits and crush their efforts against us, instead of trying to fight government incompetence, which has been endemic all along (with the occasional exception of luminaries like Senators McCoy, Banks, Grafstein and Day).

Meanwhile, in an exclusive interview with RoadKill Radio night before last, Senator McCoy did mention that ever since 9/11, and beginning with C-16, Canada’s response (read COPY) of the US  Patriot Act, legislation has taken the direction of more and more government intrusion into the lives and livelihoods of the average Canadian, and more and more restrictions of our liberties.

So, whether or not there is a “conspiracy”, and whether or not it is “theoretical” is NOT THE POINT: there is a Bill on the table in Ottawa that restricts rights in this country as never before; that allows Health Canada (for a start) to do what this arrogant agency is already doing, without lawful right, raiding the homes and businesses of honest, hardworking Canadians with guns drawn — for selling nutritional supplements!  (See Dr. Eldon Dahl’s letter to Senators HERE)

Notice that the hearings are continuing to at least the 25th of November.  That gives us…. gives YOU… the opportunity to write to the Senate, to tell them that you will not stand for your rights being threatened even by the POTENTIAL of this bill, nor will you stand for the legal landscape of this nation by giving policing and judicial authorities to its governors or their toadies.  As Senator McCoy says below: “The Bill is all about coercion, particularly by Health Canada inspectors.”

Live Blogging Bill C-6 — Part 4
Posted By Senator Elaine McCoy Nov 04 2009 02:15PM

Senate Committee hearings on Bill C-6, the Consumer Products Safety Act, continue this afternoon. One witness is scheduled to appear: Carol Osmond, Vice President, Policy for the Canadian Association of Importers and Exporter.

4.15 pm: Meeting a new witness always peaks one’s curiosity — you never know what you’re going to get. And while throngs of media are not outside the door, one lonely photographer is in the room …. ooops he left …. well, there you go! So let’s see what Ms. Osmond will have to say.

4.30 pm: Carol is now giving us an overview of the mandate of the association. She reminds us that imports represent 55 % of household consumer products in Canada. They’ve been closley watching the bill + have been consulting with Health Canada. Huzzah, while they are generally supportive, they have some concerns!

First up – section 14 has unreasonable timelines, that would overburden Health Canada.

Secondly section 30 -Mandatory recall orders should only be given to the Minister…..ALSO, companies should be given a chance to take action themselves. Several sections that give Minister powers with a broad scope without procedural safe guards are also a concern.

Well Carol, welcome to the committee! Now let’s hear more.

4.35 pm: Carol brings up the buzz topic of protectionist measures that could be a conscquence if we let this legislation pass. Carol is telling us a story about her previous experience with contract writing. She has everyone captivated by her remarks. Carol contends that a contract is your life line. You have to anticipate problems and incorporate measures to deal with those problems as the contract is being written. She agrees that legislation has to factor potential issues, but in the case of this legislation, the permissions are too broad.

4.45 pm: Senator Banks now has the mic. As always, Senator Banks has an excellent grasp of the bill before him. He is discussing the fact that there seems to be no recourse for companies if they have been found to be in violation of the Act. Carol agrees, they are not pleased with this portion, and suggests that due dilligence should be written into the bill. Senator Banks agrees that the intent is to make products safe for consumers but , he muses, are we going about this in the right way?

Precisely! Everyone wants a safe world, but is this how we make it happen?

4.55 pm: Is Christmas in the air? Because once again we’re talking about toys ….

Senator Callbeck is asking about Carol’s claim that the reporting mechanisms are too strict. To summarize Carol’s comments, companies need time to review the complaints and take appropriate measures. While we live in a global, highly communicative world, it takes time for information to work through the channels, especially relative to the size of a company and amount of their product on the shelves. 10 days may not be enough time and difficult for companies to comply with.

5:08 pm: Senator Cordy just shared a story about people cooking pork chops in toasters, then the toaster catching fire and complaints about unsafe consumer products. Yikes! This is obviously not a defect with the product — just a (the Senator hesitates as she searches for an appropriate word) — just a STUPID stupid action! So is this what the legislation encourages by way of reports? Carol seems to agree that it should not.

Now here’s a fascinating factoid: she says that the US legislation actually provides for the company to assess whether there’s product defect before it’s reported. Now that would make more sense. So, I ask you, if the Canadian government is so madly keen to live up to international standards, why on earth can’t it incorporate some of the more sensible provisions of foreign legislation????

5:20 pm: Senator Dyck is now engaging with Carol: should Health Canada have a definition of risk? Both agree that risk in the consumer product world is relative to whom the product is directed. For example, products for adults likely carry far more risk than those for children. Carol does not seem to be cottoning on to this line of questions. Well, understandable really. Senator Dyck is a PhD (neurological chemistry, to be precise). She knows all about risk assessments. Unlike lawyers (which Carol seems to be). Maybe that’s why I’ve never heard any roadkill jokes about brainiacs (and heard far too many about lawyers, thank you very much. OK, OK — full disclosure — I, too, am an LLB)

Back to the hearing now … I don’t know about you, but I’m hearing an underlying conversation in the room. The Senators and Carol are trying to balance the responsibilities and freedoms of the government, the producer and the consumer. The question is, does this legislation facilitate reaching that balance? Not likely, from what I’m hearing. The Bill is all about coercion, particularly by Health Canada inspectors.

5:27 pm: Senator Day is on the ball once again. He’s really nailed the flaws in this legislation. Apart from ridiculously vague or broad definitions, he asks about due process. Or lack thereof. Sure enough, this is a huge concern for Carol. Her organization has made any number of useful recommendations to bring this legislation into the world of natural justice. To fit with Canada’s legal traditions, in fact. All of which have obviously been ignored. Every time this point is raised, I must admit my mind simply boggles … how can you not have the right to appear before an independent tribunal to appeal a bureaucratic decision? And reasonable time lines (not just 7 days as in the Bill)? Carol actually repeats what I said last week … an appeal after the fact is of no help to anyone.

5:37 pm: Senator Martin now leaps in to share what she believes to be the intention of the bill. Hallelujah! It sounds really good. LOL … Carol just said she wishes Senator Martin herself had actually written the Act! Regrettably, what the Senator believes is written in the bill is NOT there. Oh, oh … bit of an awkward moment around the table. Can the witness be right, after all? Whoa …..

5:40 pm: Senator Keon mow takes his turn. He starts by acknowledging all the emails and calls from Canadians. Well done, all you folks out there. It’s good to know that this world famous heart surgeon, Dr. Keon, is paying attention. But now he raises a concern about international trade. So Carol explains. Currently there’s no guarantee that standards on imported products will not be greater (more onerous) than those on domestic products even though Canada has signed all sorts of treaties saying we must not treat foreigners any worse than we treat our own home grown manufacturers and distributers (whew, take a deep breath there). What Bill C-6 would do, apparently, is give those treaties some teeth in domestic legislation. Hmmm …

6:00 pm: Well, some further advocacy work by Senator Martin marks the end of the witness session. After good wishes are exchanged all round, the Chair then turns his attention to the committee’s schedule. On November 18, the Privacy Commissioner will appear. A week later, on Nov 25, Shawn Buckley will be the witness, followed the next day by the Health Minister and her officials. After that, the committee will consider what it proposes to recommend to the Senate as a whole. Senator Eggleton expresses his hope and desire to have the committee’s report finished and available by the end of November. What’s this? Senator Eaton says she doesn’t want to hear from Mr. Buckley. Because his organization believes the bill will force mandatory vaccinations. My goodness, that’s a turn up for the books. Does the Senate only listen to people it agrees with, perhaps? Ah well, never mind. She’s new, after all, and her suggestion is not accepted. So there you have it, folks. The committee will continue its hearings in a couple of weeks … stay tuned!

VICTORY AT CODEX!!! Anti-Supplement NRV Document Held Back Because of NHF

From the National Health Federation

This week of November 2-6, 2009, the 31st Session of the Codex Committee on Nutrition and Foods for Special Dietary Uses (CCNFSDU) met in Dusseldorf, Germany to continue its work in developing standards for global nutrition. Some 260 delegates were in attendance, comprised of various countries’ functionaries and international non-governmental organizations (INGOs) representatives. Never one to disappoint the crowd, Dr. Rolf Grossklaus returned for his final, farewell performance as the CCNFSDU Chairman.

The Committee covered various topics, among them methods of assaying fiber and the establishment of Nutrient Reference Values (NRVs) for Non-Communicable Diseases (NCD)./1 At the special Saturday meeting of the CCNFSDU Working Group on Nutrient Reference Values for Non-communicable Diseases, the NHF was represented by its president Scott Tips and was very active in making its pro-freedom views known. (See our previous release athttp://www.thenhf.com/press_releases/pr_01_nov_2009.html.)

At both meetings (that of the Working Group and the Committee), NHF especially took to task the God-like aura given to the “expert consultations” of Food and Agriculture Organization (FAO) and World Health Organization (WHO). These are pre-selected groups of experts with a pre-determined outcome to their “consultations” and are hardly scientific. Along with other delegations, the NHF succeeded in retaining language in Codex standards that ensured that Codex would not just look to FAO/WHO expert consultations for scientific knowledge.

Amazing Victory

But the real battle and amazing success took place on Tuesday, November 3rd, during the general session, when the two agenda items covering the NRVs for non-communicable diseases, including the “Proposed Draft Additional or Revised Nutrient Reference Values for Labelling Purposes in the Codex Guidelines on Nutrition Labelling,” were discussed by the Committee.

The CCNFSDU was all prepared to rubber-stamp its approval on the “Proposed Draft Additional or Revised Nutrient Reference Values for Labelling Purposes in the Codex Guidelines on Nutrition Labelling,” which had been pushed by the delegation of the Republic of Korea and others.l

This document was so astoundingly anti-vitamin and mineral it infuriated the NHF representative, who had to restrain himself from using harsh and insulting words when it came NHF’s turn to speak. Appendix 2 of the document is only two pages, but contains already-low values for each of the Vitamins and Minerals listed in the Appendix (except for Fluoride, which of course has an excessively high value). (To see the document, go to www.thenhf.com/press_releases/Appendix2photo11-09.pdf)

For example, the “scientific” values assigned to Vitamin C were being reduced from an already-low 60 milligrams to an even-lower 45 milligrams! The NRV for magnesium was to be cut from 300 milligrams to 240 milligrams. Niacin’s value was to be chopped from 18 milligrams to 15. These were, and are, absurd numbers, based upon nutritional ignorance.

Over a one-hour period, the NHF took the floor repeatedly to lambast the document and to insist that its adoption would be a public-relations nightmare and make Codex the laughingstock of the World. If anything, NHF said, these numbers must be drastically raised. The argument swirled around the room with the NHF holding firm against comments from many other country delegations, especially Australia (which calls harsher standards "an extra bit of comfort"), all of whom thought that these numbers were perfectly normal! Had NHF not challenged the document, there would have been no sustained opposition to its passage.

Instead, NHF kept unrelentingly hammering at the points it had first raised and answered at every chance the counter-arguments of the document’s proponents. Finally, the Chairman, perhaps in exasperation, suggested that the Committee not advance the document to its next step because there was no consensus! This “compromise” was supported by NHF but opposed by others until, with it still hanging in the balance, the Indian delegation firmly stated its support for NHF’s position and against it advancing. India’s timing was impeccable. That was enough for the Chairman, who quickly concluded the debate and held the document back.

But for the National Health Federation, India, and also Costa Rica and Iraq, this document would have advanced towards a more final, fixed form. Now, it remains in a malleable form that will let it be corrected at next year’s CCNFSDU meeting.

Increasingly recognized at these Codex meetings, NHF appreciates the support it has been given by other country-member and INGO delegations. Most of all, though, NHF appreciates the support its membership has given it, financially and morally, that enabled this victory to happen at all.

********************

1 Not to be confused with Maximum Upper Permitted Limits, Nutrient Reference Values (“NRVs”) are nothing more than souped-up RDAs. These are numerical values assigned to each nutrient so as to reflect the mythical typical person’s nutritional needs for that nutrient. By referring to the NRV for, say, magnesium, the consumer is supposed to get an idea of whether he or she is getting an adequate (or in European bureaucratic eyes, an excessive) amount of magnesium. If a consumer, for example, sees that he is getting 100% of his daily requirement for Vitamin C, he will almost certainly mistakenly think that he need look no further to supplement his diet.; he is, after all, getting his full needs met, even though 100% will be defined as 60 milligrams! These values are supposed to be set according to rigorous scientific evidence; but, as NHF has long contended, “science” at Codex levels is far more political than scientific.

Alternative Cancer

From: Croft Woodruff [mailto:croft.woodruff@gmail.com]

Subject: Alternative Cancer

Alternative Cancer on
CNN's Larry King Live

© By Peter Barry Chowka

(October 18, 2009) Nicholas Gonzalez, M.D., the subject of a two part interview series published in September 2009 in Natural Healthline, has informed me that an hour long program he taped one week ago on Larry King Live is scheduled to run on CNN during the week of October 19, 2009 – most likely on Tuesday 10/20 or Friday 10/23 – at 9 PM EDT with replays at 12 midnight ET and 3 AM ET.

The main subject of the program is actress and best-selling author Suzanne Somers. A long time proponent of alternative medicine, Somers has written a new book, Knockout: Interviews with Doctors Who Are Curing Cancer--And How to Prevent Getting It in the First Place (Crown), which is being published on October 20, 2009 and, as of this writing, is #188 on Amazon.com.

Also appearing on the program, according to Gonzalez, are Stanislaw Burzynski, M.D.,Ph.D., and two alternative cancer therapy “antagonists.”

On March 28, 2001, Somers, then 54 years old, appeared on Larry King Live to announce that she had been diagnosed with breast cancer in 2000 but had chosen to use primary alternative instead of conventional treatments.

As I reported on April 1, 2001:

Somers, a high-profile celebrity and author of best-selling diet and fitness books who initially rose to fame on the ABC-TV sitcom Three's Company in the late 1970s, said she was going public after a year-long private battle with cancer in order to counter the National Enquirer's recent reports that she had undergone liposuction because her much-hyped diet program had failed. On the CNN program, Somers confirmed that she had undergone procedures at the Lasky Clinic in Beverly Hills but said that “What I had done [there] had to do with my breast cancer.”

Somers said her cancer was diagnosed in April 2000 after which she had surgery (she implied it was a lumpectomy and not a mastectomy) followed by radiation therapy. She then went against her doctors' wishes, she said, and declined chemotherapy — and she started taking the alternative treatment Iscador, a mistletoe extract. Iscador is popular in parts of Europe but relatively unknown in the U.S. Somers incorrectly described Iscador as “homeopathic.” In fact, it is an herbal therapy that is part of Anthroposophical Medicine, based on the work of Rudolf Steiner, PhD (1861-1925), a European philosopher, scientist, educator, and the founder of Anthroposophy.

Back in 2001, Somers’ decision to go the alternative therapy route was immediately challenged by the medical Establishment. A feature article in People magazine on April 20, 2001, “A Matter of Choice,” described Somers’ treatment and the ensuing controversy.

On May 1, 2001, I reported at length on the story and on a new study of Iscador, published May 1, 2001 in Alternative Therapies in Health and Medicine. My article included an interview with the journal’s editor, David  Riley, M.D.

Regarding Burzynski, I wrote about him at length in an article originally written in 1993 and later published in 1997 in Nutrition Science News. Some excerpts:

Stanislaw Burzynskii, M.D., Ph.D., Houston, TX, 2007 at the 30th Anniversary Celebration of his work

Stanislaw Burzynski, M.D., Ph.D. Burzynski is one of the leading contemporary pioneers in the field of nontoxic cancer therapy. His therapeutic discoveries are interesting, and his personal story is fascinating and instructive. Burzynski's work was reported on positively on the probing network television investigative series 20/20 (ABC-TV, October 22, 1981) and Street Stories (CBS-TV, July 23, 1993), and more recently, ABC-TV's Nightline and CBS This Morning (April and March, 1995, respectively).

One of the youngest and brightest M.D.-Ph.D.s in his native Poland, Burzynski left home in 1970 in search of personal and professional freedom in the non-communist West. What he found instead in the U.S., he has said, was a situation reminiscent of the authoritarian one-party state he had left behind -- a scientific system in America that was run like a Communist politburo, where true innovation and independent discovery were frowned on and where pioneering thinkers were relegated to a “medical gulag.”

Through the mid-1970s, Burzynski was an assistant professor at Baylor College of Medicine in Houston. The research projects he worked on received funding from traditional sources including the federal government. Burzynski's decision in 1977 to leave Baylor and start up his own small research and treatment facility where he and his colleagues could pursue their myriad ideas and discoveries and treat late-stage cancer patients free of bureaucratic rigidity and interference, however, did not sit well with the medical powers that be.

Before he left Baylor but especially after he began working independently, Burzynski and his associates published numerous scientific papers on antineoplastons -- his term for the nontoxic urinary peptides that he discovered and that form the basis of his novel approach to treating cancer. Burzynski followed the accepted practice of publishing scientific papers on his discoveries, which he initially tested in laboratory tissue cultures and later in animals and humans.

Typical of Burzynski's extraordinary results were the outcomes for early groups of advanced cancer patients treated with antineoplastons: 60 percent enjoyed objective remission, 47 percent experienced complete remission, and 20 percent survived for over five years without cancer. These and other results are far superior to anything reported then or now for standard cancer treatments. (For example, in 1985 interleukin-2 was heavily promoted by orthodoxy, supposedly as a highly promising new treatment after a single study showed it to have been associated with a complete remission from cancer in only one patient out of twenty-four treated -- a positive response rate of only four percent!)

By choosing to work indepedently, on his own, outside of a mainstream institutional setting, Burzynski ran up against the closed mindsets and vested interests that dominate orthodox cancer research and treatment. In 1983, the influential American Cancer Society (ACS), without actually testing Burzynski's therapy or even visiting his facility, added Burzynski's antineoplastons to its list of “unproven” or “questionable” methods -- a kind of blacklisting that typically represents the first step in official marginalization. In the view of journalist [Robert] Houston and other independent observers, it is highly unlikely that a scientist whose name appears on this list can ever succeed in gaining official funding or recognition of any kind. “It's like trying to get out of hell,” Houston quips.

The entire article including more about Burzynski can be read here.

In 2007, Burzynski was a honored at a 30th anniversary celebration attended by 600 guests including long term recovered patients marking his three decades of work curing cancer with alternative methods. Julian Whitaker, M.D.’s account of the event was published in 2008 in The Townsend Letter.

Senator Elaine McCoy to discuss Bill C-6 and the Committee Meetings presently taking place in Ottawa

The featured guest will be Senator Elaine McCoy to discuss Bill C-6 and the Committee Meetings presently taking place in Ottawa on this very controversial piece of legislation.

From Free Speech Victory to Totalitarian Government and then this -Why oh why can’t we as tax-payers know how many abortions we are paying for?

It’s going to be an interesting night tonight on RoadKill Radio, with co-hosts KARI SIMPSON and TERRY O’NEILL.

7:30 pmCROWN STAYS CHARGES AGAINST CALGARY PRO-LIFE STUDENTS – What a headline!!  LEAH HALLMAN, President of Campus Pro-life will join us to talk about this amazing free-speech victory and the fear of the truth that has gripped and crippled the politically correct ideology (or as Kari calls it, “politically correct idiotology”)

8:00 pmSENATOR ELAINE MCCOY will join us to talk about Bill C-6 and the totalitarian provisions it contains.  This is important!!  This Bill has made it through Parliament and is now before the Senate and is soooo bad that some Senators are questioning the legality of it!

“The grassroots’ issues over Bills C-51, C-52 and now C-6 started as a Natural Health Product Freedom of Choice in Health Care issue, but has now spread to the entire Federal Regulatory system which affects every Canadian citizen in many aspects of their lives daily,” says the Canadian Coalition for Health Freedom.

8:45 PMTED GERK joins us with some interesting news.  Did you know that the B.C. refuses to tell inquiring minds how many abortions are being preformed and how much it is costing us the tax-payers! HEALTH CANADA IN FEDERAL COURT: Truehope Defends the Rights of All Canadians in the Federal Courts - Nov 2

Calgary, AB

A small Alberta vitamin and mineral company called Truehope will finally have its day in court beginning Monday, November 2 when the Federal Court in Calgary will determine the legality and constitutionality of Health Canada’s 2003 seizure of a vitamin and mineral combination (EMPowerplus) being used by thousands of Canadians for the prevention of bipolar symptoms.

Years of court battles over the seizure that left hundreds of desperate Canadians caught in the middle of a regulatory battle have, thus far, amounted to nothing but a huge waste of tax payer dollars. In 2006 Health Canada charged Truehope owners with the illegal sale of a drug, but the courts found them innocent of all wrong doing and demanded the Truehope vitamin and mineral supplements continue to be made available to Canadians.  Furthermore, in his final judgment, Judge G.M. Meagher concluded that even as Health Canada agents were denying access to the supplement they were fully aware that their actions would result in harm or danger to those who depended on the product for their health.[1] In the 2006 Alberta Court case the Canadian Mental Health Association’s, Alberta Director, Ron Lajeunesse bore witness that because of Health Canada’s actions in removing the supplement innocent Canadians lost hope and committed suicide.

Truehope co-founder Anthony Stephan claims that if the constitutional challenge is successful Health Canada will no longer be able to remove a product from the market without first proving in court that the removal will not harm Canadians who use it for their health. “Canadians are harmed when viable natural treatments or preventions are taken away. Drugs should not be the only option for Canadians who choose health. The judgment will extend protection to all Canadians and to all natural health products.”

Current Health Canada regulations allow bureaucrats to remove natural products at will without any accountability to Canadians for their actions.[2]  “We think this kind of unconstitutional free-for-all opens the door for corruption and for big pharma lobby, and closes the door on individual freedom and choice in personal health care,” says Stephan.

The Federal Court Review is open to the public daily from 9:30 – 4:30 and commencing November 2-20 at the Calgary Federal Court 635 8th Ave. S.W. Calgary, AB.

GO STRAIGHT TO CAMPAIGN OR LOG ONTO TO  http://www.cnhc.ca/campaign5.html

Shawn Buckley has been invited as 1 of the key 14 national witnesses to appear before Senate Committee. That's the good news.

The bad news? If you are on CNHC's Facebook you know he is in court unable to have a face to face with this Committee for 3 weeks. As of Friday October 30th the Committee has not given him another option to appear.

We need to change that because sending paperwork of his Bill C-6 discuss= ion paper does not give him an opportunity to speak for us.

NO SUBSTITUTES

It is imperative that he be allowed to give his testimony before this Committee. We all know his perspective is absolutely essential and irreplaceable.

We have only tomorrow Monday November 2 and Tuesday November 3 to let this Committee know that the public wants Shawn Buckley to represent us in Ottawa.

CNHC has written a short letter posted on the new campaign page that you can fax email or read parts of when you call tomorrow.

Vaccine skepticism is in the air

By Melissa Healy

September 14, 2009

"With the healthcare debate storming on, a study on attitudes over the flu vaccine shows a clear distrust in government. For some, such as blacks and immigrants, suspicions have deep roots."

In a time when Americans are engaged in fierce debate over the federal government's role in their healthcare, many citizens are less inclined than ever to accept the warnings of the Department of Health and Human Services or the recommendations of its Centers for Disease Control and Prevention, says Sandra Quinn, a University of Pittsburgh public health professor who has just completed a national survey of attitudes about the flu vaccine.

Vaccine refusers have long decried vaccine mandates and campaigns as an unwarranted intrusion of parents' and local school boards' rights. And against the backdrop of charges that a "public healthcare option" would hijack patients' choices, such complaints have taken on new resonance for some.

And for a new generation of vaccine skeptics, there are new objects of distrust. For some, it flows from a suspicion of the multinational corporations that develop and manufacture vaccines. For others, it comes from a belief that media outlets have hyped the pandemic flu story to secure the attention of readers and the revenue of advertisers. And many simply doubt the competency and independence of government agencies, which they believe are too inept, overwhelmed or co-opted by corporate interests to secure the safety of the nation's drugs and food supply.

Adding to the wariness toward the forthcoming H1N1 vaccine is the fact that the formulations used on patients in the United States might require the use of adjuvants -- special agents added to a vaccine mix that rev up the immune system and foster a stronger immune response

4) Bulb At A Time..

A physics teacher in high school, once told the students that while one grasshopper on the railroad tracks wouldn't slow a train very much, a billion of them would . With that thought in mind, read the following, obviously written by a good Canadian.
Good idea . . . one light bulb at a time . . . .

Check this out . I can verify this because I was in Lowe's the other day for some reason and just for the heck of it I was looking at the hose attachments . They were all made in China . The next day I was in Home Hardware and just for the heck of it I checked the hose attachments there. They were made in Canada. Start looking.

In our current economic situation, every little thing we buy or do affects someone else - even their job. So, after reading this email, I think this lady is on the right track . Let's get behind her!

My grandson likes Hershey's candy . I noticed, though, that it is marked made in Mexico now. I do not buy it any more . My favorite toothpaste Colgate is made in Mexico now. I have switched to Crest .. You have to read the labels on everything .

This past weekend I was at Wal-mart . I needed 60W light bulbs . I was in the light bulb aisle, and right next to the GE brand I normally buy was an off brand labeled, "Everyday Value. " I picked up both types of bulbs and compared the stats - they were the same except for the price. The GE bulbs were more money than the Everyday Value brand but the thing that surprised me the most was the fact that GE was made in MEXICO and the Everyday Value brand was made in - get ready for this -in Canada in a company in Ontario.

So throw out the myth that you can not find products you use every day that are made right here .

My challenge to you is to start reading the labels when you shop for everyday things and see what you can find that is made in Canada - the job you save may be your own or your neighbors!

If you accept the challenge, pass this on to others in your address book so we can all start buying Canadian, one light bulb at a time! Stop buying from overseas companies!

(We should have awakened a decade ago . . . . . . )

Let's get with the program . . . . help our fellow Canadians keep their jobs and create more jobs here in Canada.

Organic and Natural Foods Industry News

Hain Celestial Group Acquires Infinitea Kombucha

The Hain Celestial Group, Inc. (Nasdaq: HAIN), a leading natural and organic products company, today announced the acquisition of Infinitea Kombucha in Boulder, CO. Infinitea Kombucha is a producer of organic kombucha, a fermented probiotic tea, that is sold through natural food retailers.

The Infinitea Kombucha product line will no longer be manufactured. Celestial Seasonings® is expected to launch Celestial Seasonings® kombucha in Spring of 2010. Nicole Gervace, owner of Infinitea Kombucha, has joined the Company as Product Manager to manage the Celestial Seasonings kombucha product line.

Celestial Seasonings is a leader in the specialty tea category and has recently celebrated its 40th Anniversary. "We are excited about the opportunity to add kombucha to our Celestial Seasonings brand. Kombucha is a rapidly growing category and a natural brand extension into ready to drink tea," said Peter Burns, General Manager of Celestial Seasonings. "In addition, we are pleased that Nicole has become part of our team bringing her depth of knowledge and expertise in the kombucha category," continued Peter Burns.

Terms of the acquisition, which closed earlier this month, were not disclosed.

The Hain Celestial Group Proposes Back-to-Basics Approach to Product Labeling

The Hain Celestial Group, Inc. a leading natural and organic products company, today called upon all consumer packaged goods companies to adopt truth in labelling standards. These standards would clearly identify product benefits without masking product negatives by simply addressing actual ingredient and health benefits on packaging in a clear and consistent manner. Recent controversy over front-of-package labelling programs and practices has inspired Hain Celestial to assist consumers in making informed purchase decisions.

"We have long been troubled by packaging practices that lead consumers to believe that a product is healthful, when natural ingredients are just a very small percentage of the product and are accompanied by detrimental ones," stated Irwin D. Simon, President and Chief Executive Officer of The Hain Celestial Group, Inc. "For many years, we have advocated "A Healthy Way of Life(TM)" in which the enjoyment of food, including healthful snacking, can be managed without including harmful ingredients. It is time that the consumer packaged goods industry stops practices that create consumer confusion by front-labelling products as natural and healthful. Too often these products contain certain natural ingredients or nutrients, but then they also contain artificial flavours, colors, and preservatives as well as highly processed and refined ingredients, often only disclosed in the ingredient statement in small type on the package back. Misleading labelling also includes labelling a product as 'healthful' despite its containing high levels of sodium, fat and sugar. At Hain Celestial, our natural products contain only 100% natural ingredients, as we continuously work with our nutritionists to improve the nutritional quality of Hain Celestial products across our portfolio," he continued.

Hain Celestial has published a guide to understanding "The 'ABCs' of Natural", which is available at www.ahealthywayoflife.com. The Company calls to action all consumer packaged goods companies to adopt standards for natural and healthful products that use a similar model to the National Organic Program ("NOP") standards published by the United States Department of Agriculture ("USDA"). These standards require any product to be at least 95% organic before stating it is organic, and that the remaining ingredients to only be taken from the NOP approved list. Hain Celestial offers over 1,400 organic products that already meet these labelling requirements. Natural claims on products should follow suit.

"With 'natural' being the second most widely used claim on new products introduced in 2008 in the U.S. according to Mintel, and additional labelling programs being used to identify products with healthy attributes, it is time for companies to restrict the use of natural claims and accompany them with meaningful nutritional information that is consistent. We applaud the U.S. Food and Drug Administration's (the "FDA") efforts to review these practices. However, we urge the FDA to not only consider sugar, sodium and fat claims, but to also look at the character of the products and their ingredients. In addition to the quality of ingredients, it is the overall labelling practices themselves which require scrutiny," concluded Irwin Simon.

For more information on the ABCs of natural ingredients and nutrition, visit www.ahealthywayoflife.com. For more information on Hain Celestial, visit www.hain-celestial.com.

Neptune Technologies & Bioressources Inc. Announces Grant For Method of Use Patent for Cardiovascular Disease Applications in Europe

Neptune Technologies & Bioressources Inc. ("Neptune") is pleased to announce that the patent entitled "KRILL EXTRACTS FOR PREVENTION AND/OR TREATMENT OF CARDIOVASCULAR DISEASES" was issued in Europe successfully without opposition. "This new Method of Use patent is a critical achievement eliminating competition from the European cardiovascular market with any krill extract, such as krill oils other than Neptune Krill Oil," said Dr. Tina Sampalis, Chief Scientific Officer of Neptune.

Furthermore, as of October 12th, 2009, EFSA (European Food Safety Authority) officially signed its approval of Neptune Krill Oil (NKO(R)) as a NOVEL FOOD and PARNUTS for immediate commercialization in the European Union. The EFSA Novel Food decision is specifically addressed to Neptune and is hence, under Regulation 258/97, applicant-linked. "Being patent protected and the pioneer at penetrating the European market is a strategically significant accomplishment, allowing Neptune to pursue this market in an open field," said Dr. Wael Massrieh, Director of R&D of Neptune.

"The placing in the EU market of novel food or novel food ingredients which have not been authorized or notified within the framework of Regulation 258/97 will have as a consequence the immediate withdrawal of the non-compliant products from the EU market by the competent national authorities of the Member States by notification of the Commission through the Rapid Alert System for Food and Feed (RASFF). This is in addition to any other liabilities that can be deducted from the Member States' national legislation. Moreover, violating Neptune's rights by infringing on any of its patents by any players in the krill oil market is also considered a legal offence," added Dr. Sampalis.

"Recently, we observed players cheating on the market and misleading consumers by selling krill oil in Europe without any regulatory approval. We also noticed that they advertise unproven health benefits with their products as well as infringe on our patents. This was surprising until we realized who were involved. These situations will be addressed as required," said Henri Harland, Chief Executive Officer and President of Neptune.

About Neptune

The Company focuses on growing consumer health markets including cardiovascular, inflammatory and neurological diseases driven by consumers taking a more proactive approach to managing health and preventing disease. The Company sponsors clinical trials aimed to demonstrate its product health benefits and to obtain regulatory approval for label health claims. Neptune is continuously expanding its intellectual property portfolio as well as clinical studies and regulatory approvals. Neptune's products are marketed and distributed in over 20 countries worldwide.

About Acasti Pharma Inc.

Acasti Pharma is developing a product portfolio of proprietary novel long-chain omega-3 phospholipids. Phospholipids are the major component of cell membranes and are essential for all vital cell processes. They are one of the principal constituents of High Density Lipoprotein (good cholesterol) and, as such, play an important role in modulating cholesterol efflux. Acasti Pharma's proprietary novel phospholipids carry and functionalize the polyunsaturated omega-3 fatty acids EPA and DHA, which have been shown to have substantial health benefits and which are stabilized by potent antioxidants. Acasti Pharma is focusing initially on treatments for chronic cardiovascular conditions within the over-the-counter, medical food and prescription drug markets.

About NeuroBioPharm

NeuroBioPharm is pursuing pharmaceutical neurological applications, and a clinical study for a medical food product with a multinational partner is already initiated. The development of a prescription drug candidate is currently in progress. Advanced clinical development and commercialization is planned to be carried out with multinational partners.

Total Nutraceutical Solutions To Launch Natural Organic Whole Food Mushroom Vitamin D Supplement

Total Nutraceutical Solutions, Inc. (TNS), announced today that the company has formulated and will launch a unique natural whole food mushroom-based Vitamin D supplement. This supplement is plant-based and not animal-based and provides a new approach to Vitamin D supplementation in health-conscious individuals. A proprietary grown mushroom, Agaricus blazei Murill (AbM) by Sylvan Bio, Inc. and Creekside Mushrooms Limited will be stimulated with UV light to produce natural organic Vitamin D2 within the mushroom. The need for this product is underscored by the following statement in the October 26, 2009 issue of the Archives of Internal Medicine: "The worldwide prevalence of Vitamin D deficiency is striking and more than 40% of the population may be Vitamin D deficient." (Vol.169 No.19, pp.1806-1808).The importance of the timing of this product launch and the need for a natural whole food form of Vitamin D is further evidenced by a recent statement by the Office of Dietary Supplements, National Institutes of Health, that the second-best source of Vitamin D is 3 ounces of mushrooms enriched with Vitamin D. Many medical organizations, including the American Academy of Pediatricians, have advocated increased intake of Vitamin D, especially in children. Children's Hospital Boston reports that 62% of children taking multivitamins had below normal levels of vitamin D (USA Today, October 26, 2009). TNS has developed technologic capability that will allow production of a daily oral encapsulated natural supplement that contains enough Vitamin D equal to or greater than ten 8-ounce servings of Vitamin D fortified milk, at a cost that is affordable by most people.

According to the 2005 Dietary Guidelines for Americans, "nutrient needs should be met primarily through consuming foods. Foods provide an array of nutrients and other compounds that may have beneficial effects on health." (http://www.health.gov/dietaryguidlines/dga2005/document/default.htm) This statement was recently supported by a TNS experiment that revealed that ingestion of a natural organic edible whole food could increase biologic survival in a nutritionally deprived organism. Unaltered and Vitamin D2 enriched dried powders of the mushroom Agaricus blazei Murill by Sylvan significantly increased survival above controls, 4% and 15% respectively (TNUS.OB; September 30, 2009).

Vitamin D, also called the "sunshine vitamin," has recently received much attention as a needed nutritional supplement to improve human health. Decreased levels of Vitamin D have been associated with a range of diseases, such as osteoporosis, osteoarthritis, cancer of the breast, diabetes, cardiovascular disease, and many others.

TNS has purchased a Steripulse(R) - XL 3000 Pulsed UVB light system from Xenon Corporation, Wilmington, MA, and the system is being installed at Columbia Nutritional Services, Vancouver, WA, the TNS contract manufacturer. TNS has acquired from The Penn State Research Foundation (PSRF) an option to license an invention entitled "Rapid Generation of Vitamin D2 from Mushrooms and Fungi Using Pulsed UV-light" (The Invention). A U.S. Provisional Patent Application was filed on April 23, 2008 and names Professor Robert B. Beelman, and Graduate Student Michael Kalaras as co-inventors, Department of Food Science, Pennsylvania State University (PSU).

"As a doctor, I receive no greater pleasure than having the opportunity to create products that can help people live longer and healthier lives," stated Marvin S. Hausman MD, CEO, Total Nutraceutical Solutions, Inc. "Vitamin D deficiency is worldwide, is implicated in many diseases, and this product has the potential to provide a needed nutritional answer to this problem."

"I am very excited that our new process is being commercially utilized to produce Vitamin D--rich dietary supplements made from the highly nutritious Agaricus blazei mushroom," stated Robert B. Beelman Ph.D., Professor of Food Science, Pennsylvania State University. "I believe this product will be the first of its kind made from a whole food that will appeal to health conscious individuals that desire to consume a plant-based diet."

Sylvan Bio, Inc. is an emerging leader in providing innovative fungal products to a variety of industries. Based in Kittanning, Pennsylvania, it is a wholly owned subsidiary of Sylvan Inc., also based in Kittanning. Sylvan Inc. serves mushroom, agricultural and nutraceutical markets through its prominence in fungal technology and solid-substrate fermentation.

Creekside Mushrooms Limited is the largest single site fully integrated and highly technological "underground" mushroom growing farm in the world. Creekside's unique underground farm is scientifically monitored to provide ideal year-round growing conditions to consistently produce the highest quality mushrooms, which are 100% organic.

Suzzane Somers' book "Knockout" & S. Burzynski interview on Larry King

Watching Larry King's interview last night with Somers, Burzynski, Dr. Black of the Cedars-Sinai Hospital and Dr. Brawley, Head of the Cancer Institute, I was torn between my innate skeptical nature (regarding both sides of this issue) and my desire to believe that the FDA and the medical profession do indeed "doctor" the research and findings to suit their goals (whatever they may be) in the battle to cure cancer. Somers is clearly passionate about her position and also obviously intent on winning converts and selling her new book. Burzynski of course has a vested interest in obtaining as many patients for his Houston clinic as possible. I'm left wondering if this kind of celebrity publicity does any good for those who are suffering from any type of cancer and / or in the throes of chemo.

Today I've been reading up on Burzynski and Somers and her new book on the net and found lots of interesting info. Here's a couple of examples. Looking forward to any comments.

Barbara

From Quackwatch.org:
"Stanislaw Burzynski and "Antineoplastons"
(by) Saul Green, Ph.D.
Unlike most "alternative medicine" practitioners, Stanislaw R. Burzynski has published profusely. The sheer volume of his publications impresses patients, but unless they understand what they are reading, they cannot judge its validity. To a scientist, Burzynski's literature contains clear evidence that his data do not support his claims."

And from Stevensponaugle's Blog on wordpress.com:

"Knockout," Interviews with Doctors who are curing cancer.

"Moving, Touching, Brilliant, Incisive, Vitally Important and Profound, October 22, 2009
By Steven Sponaugle "Research Director, Florida … – See all my reviews

"In Knockout, Suzzane Somers, exposes the financial conspiracy between Oncologists, Pharmaceutical Companies and the FDA, which perpetuates domination of cancer treatment with brutal, ineffective chemotherapy and radiation treatments.

"She also reveals how she was misdiagnosed with cancer, during a medical emergency and was intensely pressured to accept the deadly recommendation of unecessary chemotherapy and radiation. If it happened to Suzzane Somers, it could happen to you. Fortunately, she was able to call Dr. Jonathan Wright, one of the world's most brilliant medical pioneers, who advised her to refuse chmotherapy, against medical advice of five robotic hospital physicians. The oncologist who misdiagnosed her should be sued for malpractice.

"The story of Dr. Stanislaw Burzynski is very inspiring and touching. He is an absolutely brilliant courageous genious, achieving vastly higher cancer cure rates, than prevalent primitive, crude cancer radiation and chemotherapy. The patient stories bring the book to life, in a very touching powerful way.

"Sadly, persecution of medical pioneers and resistence to progress has persisted through the ages. Semmelweiss, Pasteur, Royal Rife, Kilmer McCully, Jonathan Wright, and Stanislaw Burzynski were all persecuted for revealing new medical knowlege. Arthur Schopenhauer unfortunately was correct when he observed, "At first the truth is ridiculed, then it is violently resisted, then it is accepted as self evident."

"Hopefully the vastly more effective cancer treatments described in Knockout, will pass through the first two stages more quickly, with the additional publicity this book creates.

"This is a difficult book to put down – I wish I had time to read it nonstop. This book adds to the evidence that Suzzane Somers has become one of the nations best medical journalists."
